Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Wizley ("Wizley", "we", "us", or "our") governing your access to and use of our website, platform, and related services (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your account credentials, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

The Services

Wizley provisions and operates lead-generation infrastructure on your behalf, which may include registering a domain, standing up a sending identity, provisioning a phone number, submitting messaging registrations, deploying funnel pages, and generating legal pages, all based on the legal identity and information you supply. You are responsible for the accuracy and lawfulness of the information you provide for these purposes.

Your responsibilities

  • You will use the Services in compliance with all applicable laws and regulations, including those governing advertising, marketing, email, and telephone and text messaging.
  • You will obtain and maintain any consents required to contact your leads and customers, and you will honor opt-out requests.
  • You will not use the Services to send unlawful, deceptive, harassing, or unsolicited communications, and you will comply with our Acceptable Use Policy.
  • You are responsible for your own content and for your relationships with your leads and customers.

Fees and payment

Paid Services are billed on a subscription basis through our payment provider. You authorize us to charge your payment method on a recurring basis until you cancel. Fees are non-refundable except where required by law or expressly stated. We may change our fees on prospective notice; continued use after a change takes effect constitutes acceptance of the new fees.

Launch rate. If you sign up and pay for a plan on or before January 31, 2027 (through the end of that day, Pacific time), your monthly plan price stays at the launch rate of whichever plan you are on ($499 for Wizley Pro, $99 for Wizley Partner) for as long as your plan continues without being canceled; a pause or a late payment does not end it. Once your plan is canceled, a later plan is charged at the price in effect when it starts, which for an agent who joins after that date is $549 for Wizley Pro and $149 for Wizley Partner.

Setup fee. When you sign up we charge a one-time setup fee of $50. It is not refundable. Your first month is charged separately, on the day your ads go live, and your monthly billing period runs from that day. If your ads never go live and there is no activity on your account for 60 days, we email you before we close the account; the setup fee is not refunded when that happens.

Ad budget and our fee on it. Where we run advertising on your behalf, you set a monthly ad budget and we charge your payment method that budget plus a fee of 10 percent of it, in advance. The fee is charged on the budget you load and is our compensation for operating the advertising account your campaigns run in. The fee is not refundable, with one exception: if your ads never ran at all, whether because the advertising platform refused them or because of a failure on our side, we refund both the unspent budget and the fee charged on it. Unspent ad budget is otherwise returned to you as described in our account-closure process. The ad budget you load is a prepayment for advertising services and is not held in trust, in escrow, or in a segregated account; it is recorded as a balance on your account and your right to it is a contractual right againstWizley, not ownership of particular funds. The setup fee above is kept, with one exception: if you delete your account before your monthly billing has started and then ask us to restore it, we refund the setup fee you paid and you pay it once when you start your plan again, so you never pay it twice.

Third-party services

The Services rely on third-party providers, including hosting, email, telephony, calendar, advertising, and payment platforms. Your use of those services through Wizley may also be subject to their terms. We are not responsible for the acts or omissions of third-party providers.

Intellectual property

Wizley and its licensors own all rights in the Services, including the software, design, and content we provide. We grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription. You retain ownership of the content and data you provide, and you grant us the rights necessary to operate the Services on your behalf.

Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that they will produce any particular business result. Wizley does not provide legal advice; the legal pages and compliance features are tools, and you remain responsible for your own compliance.

Limitation of liability

To the fullest extent permitted by law, Wizley will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability arising out of or relating to the Services will not exceed the amounts you paid us in the twelve months before the event giving rise to the claim.

Termination

Pausing. Where we offer a pause, a paused account pays no plan fee and receives no included usage: you are billed only for the usage you actually run. The plan fee stops at your next invoice rather than on the day you pause, and the month already paid for is not refunded. A pause lasts at most 3 months, we remind you before it ends, and at the end of it the account closes rather than restarting on its own.

Plans priced on a team relationship. Where your price depends on your membership of a team we sponsor, that price ends when the membership does. We will tell you, and you then have 30 days billed at usage only in which to move to the standard price. If you have not by the end of that period, the account closes and your data is exported to you.

You may cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Services in a manner that creates risk or legal exposure. On termination, your right to use the Services ends; certain provisions survive, including those on fees owed, intellectual property, disclaimers, and limitation of liability.

Governing law

These Terms are governed by the laws of the United States and of the State of California, where Wizley LLC is organized, without regard to conflict-of-laws rules. Any dispute will be resolved in the courts located there, unless otherwise required by applicable law.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide notice through the Services or by email. Continued use after changes take effect constitutes acceptance.
